End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and The Sanctuary CA (“Company,” “we,” “us,” or “our”), governing your use of the The Sanctuary CA mobile application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the App.
1. License Grant
The Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes strictly in accordance with this Agreement.
2. Eligibility
You must be 21 years of age or older (or 18+ with a valid medical cannabis recommendation under California law) to use this App. By using the App, you represent and warrant that you meet these requirements.
3. Restrictions
You agree that you will not:

Copy, modify, or create derivative works of the App.

Distribute, sell, sublicense, rent, lease, or lend the App to any third party.

Reverse engineer, decompile, or disassemble the App.

Use the App for any unlawful purpose, including activities prohibited under California cannabis laws or federal law.

Interfere with the security, functionality, or integrity of the App.
4. Cannabis Product Information
The App may provide information regarding cannabis products offered at The Sanctuary CA. Such information is for informational purposes only and does not constitute medical advice. Always consult a licensed healthcare provider before using cannabis products.
5. Ordering, Pickup, and Delivery

Orders placed through the App are subject to age and identity verification at the time of pickup or delivery. A valid, government-issued photo ID must be presented.

Orders are subject to availability and applicable purchase limits under California cannabis regulations.

Delivery, if offered, will only be made to eligible addresses within California in compliance with the California Department of Cannabis Control (DCC) regulations.

We reserve the right to refuse service to anyone who does not comply with applicable laws, appears impaired at pickup/delivery, or attempts to purchase more than the legal limit.
6. Compliance with Law
You agree to use the App and any cannabis products purchased through it only in accordance with:

California state cannabis laws and regulations; and

Any applicable local ordinances where you reside or consume products.
You acknowledge that cannabis remains illegal under federal law, and you assume all risks associated with possession, use, and transport.
7. Updates & Changes
We may provide updates or modifications to the App at any time. These updates may improve, enhance, or remove functionality. Continued use of the App after updates signifies acceptance of the revised Agreement.
8. Privacy Policy
Your use of the App is also governed by our [Privacy Policy], which explains how we collect, use, and share your data. Please review it carefully.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure use of the App.
10. Limitation of Liability
To the fullest extent permitted by law, The Sanctuary CA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use the App, including but not limited to issues related to cannabis product purchases, delays, or regulatory compliance.
11. Termination
We may suspend or terminate your license and access to the App at any time, with or without notice, if you violate this Agreement, engage in unlawful activity, or otherwise misuse the App.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
